| Course Description | Since 1 January 2011, the Trade Practices Act 1974 has been retitled the (CTH) Competition and Consumer Act 2010 (the `CCA'). The object of the CCA is the enhancement of the welfare of Australians through the promotion of competition and fair trading and provision for consumer protection and for other purposes. The Act can be divided into two. They are competition and consumer protection. The substantive provisions regulating restrictions on competition are contained in Part IV of the CCA. Regarding consumer protection, the original statutory provision proscribing misleading or deceptive conduct, or conduct that is likely to mislead or deceive, found in section 52(1) of the former (CTH) Trade Practices Act 1974, is reiterated in section 18(1) of the Australian Consumer Law (the `ACL') (which is found in Schedule 2 of the (CTH) Competition and Consumer Act 2010 (the `2010 Act'). |
