Schedule 1: Definitions and Glossary of Terms

AgreementThe University of Adelaide Enterprise Agreement 2010 - 2013.
AreaA school, faculty, or branch.
Consultation Discussions between the University and staff, with the views expressed by both parties, taken into account before any final decisions are made by the University.

Continuous Service

Continuous Service - Maternity/Adoption Leave

Is employment where there has been no break in employment or term of engagement for a period of no greater than eight (8) weeks.

Employment will be considered continuous for the purposes of eligibility for maternity/adoption leave where breaks in service do not exceed eight weeks.

Disciplinary ActionAction taken by the University to discipline a staff member for unsatisfactory performance, misconduct or serious misconduct will be limited to:
(a) formal censure or counseling; or
(b) demotion by one or more classification levels or increments; or
(c) withholding of an increment; or
(d) suspension with or without pay; or
(e) termination of employment (excluding misconduct).
Executive ManagerDeputy Vice-Chancellors, Vice President(s), Pro Vice-Chancellors, Executive Deans, Director Human Resources or a person acting in these positions.
Family MemberFamily Member means a relative by blood, marriage, adoption, fostering, traditional kinship or a person in a bona fide domestic, de facto or household relationship; and
A child, parent, grandparent, grandchild or sibling of a de facto partner.
Ordinary Rate of PayRefers to a staff member's substantive classification rate of pay, and does not include incentive-based payments and bonuses, loadings (other than clinical loadings), monetary allowances, overtime or penalty rates.
OutsourcingOutsourcing is the movement of a function (in-part or in-whole) inside the University to an entity (which may include a sole trader) outside it and includes the creation of a contract for services (expressed or implied) between the University and the outside entity in circumstances where the work to be performed under the contract for services was work performed by staff of the University prior to the creation of the contract for services.
Recognised Service for the purposes of Special Studies ProgramRecognised Service means prior continuous service with the University of Adelaide, or another institution of higher education (or equivalent), where that institution operates a Special Studies Program (or an equivalent program).
RedeploymentThe transfer by the University of a staff member, whose position has been declared redundant, into a suitable position.
RepresentativeFor any matter arising out of the application of this Agreement, an affected staff member may request assistance or representation by a union or a person of his/her choice provided that the individual is not a practicing solicitor or barrister for internal processes.
Senior ManagerAs detailed in Schedule 4 - Professional Staff Salaries.
Staff MemberA person employed by the University of Adelaide.
Voluntary RedundancyVoluntary Redundancy occurs when a staff member holding a position that has been declared redundant separates from the University on a voluntary basis.
RetrenchmentRetrenchment occurs when a staff member holding a position that has been declared redundant is unable to be redeployed into a suitable continuing position in the University and has not accepted a voluntary redundancy payment.
Working DayMonday to Friday excluding public holidays.
YouRefers to a staff member employed by the University of Adelaide and covered by this Agreement.
