When will negotiation commence?
The University received a Log of Claims from the NTEU in December2012 and a request to commence negotiation on the 4 February 2013. The Fair Work Act 2009, states that negotiation does not have to commence until after the expiry of the existing enterprise agreement.
The University of Adelaide Enterprise Agreement 2010 – 2013 has a nominal expiry of the 31 March 2012. As a sign of good faith bargaining, the University has agreed to a first negotiation meeting on the 28 March 2013.
What happens if negotiations are not finalised until after the current enterprise agreement expires?
Your employment conditions will continue to be governed by the existing enterprise agreement until such time that a new agreement has been reached and approved by Fair Work Australia.
What will my enterprise agreement pay rise be this year?
On 31 December 2012, all staff received a salary increase of 4.5% for the year 2013. Therefore no further salary increases, as a result of enterprise agreement negotiations, will be applied during 2013.
Where applicable staff are still entitled incremental rate increases pursuant to clause 3.2.2 of the enterprise agreement.
