ABSTRACT The letter informs the Chief Secretary of decisions already made by the Council of the Adelaide University Association, including classes currently offered, suggested modifications to terms of Mr. Hughes endowment, authority of governing body to determine subjects taught by Professors, and University authorities to have power to decide how endowment is to be invested. TRANSCRIPTION [Page 1] Adelaide 25th July, 1873 J. Boothby Esqr Under Secretary Sir In order that the Honorable the Chief Secretary may, previous to receiving the deputation from the Council of the Adelaide University Association tomorrow, be in some measure acquainted with what has already been done, I am instructed to transmit herewith for his information printed copy of a Report presented by the Council to a general meeting of the Association in April last. A majority of that meeting having disapproved of the arrangements that were then submitted for the immediate opening of classes in at least five distinct branches of University studies, the Council have been unable to do more than provide for temporary evening classes during the current session, conducted in Classics by the Revd Henry Read M.A., and in English Literature and Mental and Moral Philosophy by the Revd John Davidson. In accordance with the views repressed at the meeting of the Association, the Council have addressed Mr Hughes inviting his concurrence in the following suggested modifications of the terms of his deeds of gifts. 1st That the Governing Body which the Act of Incorporation will call into existence shall be at [Page 2] liberty to define the precise subjects of which the two gentlemen nominated by Mr Hughes shall be permanently Professors. 2nd That when one or other of the Chairs endowed by Mr Hughes becomes vacant, the Governing Body shall be at liberty to vary the subjects to be taught from that Chairs. 3rd That the University Authorities be empowered to vary the mode of investments of the funds to be received under Mr Hughes' endowment, that being at present limited to Bonds of the South Australian Government only. TRANSCRIPTION [Page 1] 31 July 1873 The Under Secretary [Page 2] 777/73 Chief Secretary's Office Adelaide 31 July 1873 Sir I am directed to inform you that the Chief Secretary has brought under the notice of the Cabinet, the several requests made by the Deputation from the Council of the Adelaide University Association which waited upon him on the 20th Instant and to request you to be so good as to inform the Council that the subjects have received careful consideration, and that the following decisions have been arrived at. 1st The Government George young Esqr Honorary Secretary Adelaide University Association [Page 3] 1st The Government will be prepared to grant a site for the proposed University, East of the Gun Shed, facing North Terrace but reserve to themselves the right of approving the Plans and elevation of the Building, in order to ensure uniformity of Design with the additions shortly to be made to the South Australian Institute. 2nd They will introduce to Parliament the necessary Bill of Incorporation. 3rd They will recommend the Legislature to pass a Bill granting a sum of money towards the cost of erecting the Building, equal in amount to that raised by private subscriptions for that object, to an extent not exceeding ten thousand [Page 4] Ten Thousand Pounds (£10.000) and they will also recommend that provision be made in the Bill, for securing an annual Grant, equal to what would accrue at the five percent interest per Annum, on other subscriptions, not in aid of the Building expenses, all such moneys being securely vested in Trustees, for the purposes of the University. The Council have thought it desirable that this important communication should be submitted to and considered by the general body of the University Association(,) a meeting for which purpose will be held this afternoon. Meanwhile in reference to the proposal that "provision shall be made in the Bill for securing an Annual grant equal to what would accrue at five per cent interest per annum on Subscriptions not in aid of the building expenses, all such moneys being securely vested in Trustees for the purposes of The University" I am instructed to state that the gift of £20000 by Mr. W. W. Hughes is at present in the form of his personal bond to Alexander Hay Esqr as Treasurer of the Association payable in ten years from 24th Dec 1872, for paying interest during the intervening period at the rate of six per cent per annum, and to ask respectfully whether the Government would be willing to include that £20000 while thus secured, in the amount which they would recommend to be supplemented in the manner proposed. TRANSCRIPTION [Page 1] Adelaide 16th August 1873 To the Under Secretary Sir Your letter of 31st July having been submitted to a specially convened meeting of the Members of the University Association; I have the honor to state for the information of the Honorable the Chief Secretary that while gratefully acknowledging his prompt attention in submitting to the Cabinet the requests addressed to him by a Deputation from their Council and in communicating the decisions arrived at, the Association are unanimous in feeling that the proposed course of limiting the aid of Government in a work of such national importance as the establishment of a University to an amount not in excess of the contributions of private colonists, a course altogether at variance with the examples of New South Wales, Victoria and New Zealand, would have the effect of seriously crippling the efforts of the Association. They therefore adopted the following resolutions, which I have now the honor to request that you will lay before the Chief Secretary, with the expression of their respectful hope that they may receive his [Page 2] favorable consideration with a view to their being adopted and recommended to Parliament in the Bill of Incorporation. 1st That in addition to granting a site the Government be requested to provide suitable buildings as these are required 2nd That irrespective of what the public may contribute for endowment purposes the Government be requested to propose an Annual grant for endowment of not less than (£4000) Four Thousand pounds. 3rd That the Government be requested to recommend the Trustees of the Institute to provide accommodation as far as possible for the present wants of the University. I am not sure if you are aware that the council of the Association has been for some weeks in frequent communication with Government relations to the Bill for an Act to Incorporate a University. Latterly such communication has taken place between the Attorney General and Mr. Thrupp as Solicitor to the Association, and I should be apprehensive of some complaints as to departure from customary etiquette where papers now to be furnished through any other channel. You will see that the Bill places the nomination of members of the Council of the University in the hands of the Governor. TRANSCRIPTION [Page 1] 22 Nov 1873 Under Secretary with copy of letter in reply [Page 2] Chief Secretary's Office Adelaide 22nd Nov 1873 896/73 Sir With reference to the draft Bill for Incorporation of the Adelaide University, forwarded in your letter of the 13th Instant, I am directed by the Chief Secretary to inform you that the Honorable the Speaker has intimated that in his opinion the measure is a Private Bill and must be introduced as such. Boothby Under Secretary [Page 3] Adelaide 24 November 1873 To the under Secretary Sir I have the honor to acknowledge receipt of your letter of 22nd Nov. intimating that the Honorable the Speaker regards the proposed measure for the incorporation of a University as a Private Bill and that it must be introduced into Parliament as such. The Council of the University Association feeling that such a course would almost certainly render it impossible that the measure should be passed or even introduced during the present session, instruct me now respectfully to convey through you their request that the Honorable the Chief Secretary would kindly name the earliest time at which it would be convenient for him to receive a small deputation from their number with the view of ascertaining the possibility of a suspension of the standing orders of the House of Assembly being agreed to, or of some other course being adopted which would admit of the introduction of the Bill at once.
